Terms and Conditions

Definitions:
-
“Omori Retreat” is the Yoga Teacher Training Retreat from 15-21 April 2024 at Omori Lodge.
-
“Kula Retreat” is the Yoga Teacher Training Retreat from 31 May - 02 June 2024 at Kula Muriwai.
-
"Participant" denotes those who have successfully registered and have been approved for the Retreat.
-
"Organiser" is Your Time Yoga, the coordinating body for the Retreat.
-
Additional terms may be further defined within this document.

Enrolment:
-
Candidates can register for the Retreat by filling out the online form at https://www.yourtimeyoga.co.nz/200houryogateachertrainingenrolment.

Enrolment is contingent upon meeting certain criteria like age, health, and previous yoga experience, as specified on the form.

All applications must be submitted by 01 March 2024. Later applications will be waitlisted.

Fees:
-
Retreat costs are $3300 for shared accommodation and $6300 for private accommodation.
-
Payments can be done through PayPal or bank transfer, and are due by 10 April 2024.
-
A $100 deposit confirms your place and is refundable up to 01 January 2024. Beyond this date, it becomes non-refundable.

Cancellation Policy:
-
Cancellation requires a written email notice to info@yourtimeyogaco.nz.

Cancellations by 01 January 2024 are fully refunded. Those by 01 March 2024 get 70% of fees (minus the deposit) back. Cancellations by 01 April 2024 receive a 40% refund (excluding deposit).

Post 01 April 2024 cancellations won't be refunded.

Liability Waiver:

Participants release the Organiser from any claims of injury or damages sustained during the Retreat.

It's recommended that participants have relevant health and accident insurance.

Intellectual Property:
-
The Organiser retains ownership of all Retreat materials.
-
Participants receive a personal, non-transferable license to use these materials for personal and professional growth.

Dispute Resolution:
-
Initially, disputes regarding this agreement or the Retreat should be settled via mediation.
-
If legal action is unavoidable, the winning party is entitled to its legal expenses.
-

House Rules:
-
Behaviour Expectations: All participants and teachers are expected to treat each other with respect and courtesy at all times during the retreat. Foul language and rudeness directed at another member of the retreat will not be permitted. Any disputes between roommates must be raised with Yasmin Ivy Smith for mediation and immediate resolution. Your time yoga reserves the right to ask any participant to leave should their behaviour become disruptive or destructive.

- Facility Use: All participants are responsible for keeping their assigned rooms and bathrooms tidy during the Omori Retreat and Kula Retreat. Participants are not expected to help in the kitchen however can do so if they feel called to help.

Attendance: A 95% class attendance is required to pass the course. There may be an opportunity for a curated solution should any participants not be able to make it to classes for reasons outside of their control. ​​

Alcohol and Drug Policy: Both Omori Retreat and Kula Retreat are alcohol and and drug-free. Participants may use prescribed medicine and are encouraged to continue to take any necessary medicines.

Dress Code: Participants are encouraged to wear clothing they feel comfortable to practice in for Asana group classes and workshops. Participants should bring one completely white outfit for the final dinner at both the Omori Retreat and the Kula Retreat.

Non-Disclosure Agreement (NDA):
-
Definition of Confidential Information: Your time yoga values privacy and discretion. Other participants names and identities, photos that identify other participants and the specifics of the retreat menu are all deemed confidential information.

Photographs and video footage: Participants must get permission from fellow retreat attendees before posting any photographs or video footage that includes them on social media or in the news or regular media.

Obligations of Receiving Party: In return, the Organiser must get permission from participants before posting any photographs or video footage that includes them on social media or in the news or regular media.
-
Duration: Participants are required by law to maintain this Non-Disclosure Agreement as part of the terms and conditions for Omori Retreat and Kula Retreat in perpetuity.

Return/Destruction of Confidential Info: Your time yoga maintains the right to request the destruction of any photographs or video footage from Omori Retreat or Kula Retreat that is deemed offensive.

Governing Law and Jurisdiction:

These Terms and Conditions and the agreement between participants and the Organiser are governed by the laws of New Zealand. Both parties agree to submit to the exclusive jurisdiction of the New Zealand courts in relation to any dispute arising out of or in connection with these Terms and Conditions or their subject matter.

Amendments:

The Organiser retains the right to amend these Terms and Conditions without prior notice. However, the Organiser will ensure participants are informed of any significant changes in a timely manner.

Participant's Representations:

By joining the retreat, participants represent and warrant that they are physically and medically fit to participate in all activities of the retreat and that they do not have any health conditions that would make participation unsafe or dangerous to themselves or others.

Personal Belongings:
-
Participants are responsible for their personal belongings at all times. The Organiser is not responsible for any loss, theft, or damage to participants’ personal belongings during the Retreat. It's advised that participants take proper care and precaution with their belongings and consider getting appropriate insurance for valuable items.

Communication:

By enrolling in the Retreat, participants agree to receive communication from the Organiser, including but not limited to, information about the retreat, updates, and promotional offers. Participants can opt-out of promotional communications at any time by following the unsubscribe instructions provided in each email.

Entire Agreement:

These Terms and Conditions represent the entire agreement between the Organiser and the participant in relation to the Retreat and supersede all prior discussions, correspondence, negotiations, understandings, and agreements in relation to the Retreat.

Severability:

If any part of these Terms and Conditions is found to be unenforceable or invalid, that part will be limited or eliminated to the minimum extent necessary so that these Terms and Conditions will otherwise remain in full force and effect.

Acknowledgment:

By signing up for the Retreat, participants acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions. They further attest to having had the opportunity to seek legal counsel before agreeing to these terms.

Participants are encouraged to print a copy of these Terms and Conditions for their records.
